1. General Policy

By subscribing to OffshoreUp LLC, you agree that all services are non-refundable.

Our subscriptions involve personalized digital content creation and manual labor tailored to your unique needs, which cannot be reused or resold. As a low-cost, month-to-month creative service (not a full-service agency), we prioritize affordability and flexibility—you may cancel anytime, but refunds are excluded.

While we aim to meet your expectations, this is not a “pay only if satisfied” model. You are paying for our team’s time, expertise, and allocated resources to produce deliverables based on your instructions, feedback, and revisions. We do not guarantee specific marketing outcomes, audience growth, or engagement metrics, but we commit to refining content until it aligns with your vision.

OffshoreUp operates as a subscription, not an on-demand service. By reserving team capacity for your account, unused services (e.g., delayed feedback, inactive use) do not qualify for full or partial refunds.

  • No Satisfaction Guarantees: You pay for creative deliverables based on your brief and feedback, not guaranteed outcomes.

  • Credits Over Refunds: If we fail to deliver at least one post/month, you’ll receive a credit (never a refund).

2. Deliverables

  • Revisions are permitted pre-approval. Once approved, deliverables are final.

  • Dissatisfaction does not warrant refunds; we will revise content per your feedback.

3. Cancellation & Renewal

  • Cancel Anytime: By sending a cancellation request by email to info@offshoreup.com. No prorated refunds.

  • Automatic Renewals: Charges recur monthly. Renewed subscriptions are non-refundable, and you must accept deliverables for the billing period.

4. Results & Client Responsibilities

Content creation is one element of your broader business strategy. OffshoreUp LLC does not guarantee specific outcomes—including engagement, audience growth, or revenue—as results depend on variables outside our control (e.g., platform algorithms, market trends, audience behavior).

  • Final Approval = Client Accountability: You retain final authority over content approval. We craft deliverables based on your instructions and feedback, but their post-publication impact is beyond our scope of responsibility.

  • Payment for Creative Labor, Not Outcomes: Fees cover our team’s time and expertise to produce bespoke content tailored to your needs, not assured results.

Success hinges on collaboration: Clear communication and timely feedback help align deliverables with your objectives.

5. Onboarding & Sign-Up Process

  • Incomplete Onboarding
    Failure to submit the required onboarding questionnaire does not entitle you to a refund. However, we may convert your payment into non-expiring credits for future services at our sole discretion.
  • Post-Submission Refund Requests
    • No Refunds After Submission: Service production begins immediately upon questionnaire completion. Refund requests after submission are denied, as resources are already allocated to your account.

    • Credit Flexibility: Depending on the stage of production, we may (at our discretion) convert payments into credits for other services if requested promptly.

6. Technical Limitations & Client Responsibilities

  • Core Service Scope

    • Your payment covers content creation only. Scheduling/posting is a complimentary add-on service.

    • Technical issues (e.g., platform errors, account bans) do not qualify for refunds, though we’ll assist in resolving them.

  • Account Connections

    • You must connect at least one social media account to our platform to enable scheduling.

    • Connection failures require manual posting of content by you. No refunds apply.

  • Platform Risks

    • We are not liable for:

      • Account suspensions or content removal by third-party platforms.

      • Posts flagged or deleted for sensitive industries (e.g., cannabis, weight loss).

    • You assume responsibility for approving all content before publication.

  • Posting Verification

    • Regularly monitor your accounts to ensure posts publish successfully.

    • Failed posts due to disconnects will be resent once resolved or posted manually by you.

  • Sensitive Content

    • Content removed for violating platform policies is your responsibility. No refunds or revisions apply.

8. Mistakes & Delays

  • QA Process & Client Responsibility

    • While we implement rigorous quality assurance checks, minor errors (e.g., typos, incorrect details, scheduling conflicts) may occasionally occur.

    • No refunds will be issued for mistakes. However, we will correct errors or create replacement posts at no extra cost.

    • You are responsible for carefully reviewing and approving all content before publication.

  • Non-Refundable Errors Include:

    • Typos, factual inaccuracies, or outdated information in deliverables.

    • Posts published on unintended dates.

    • Missed posting deadlines due to delays in feedback or technical issues (we will recreate expired posts).

– Delays

    • Client-Caused Delays

      • Delays in communication, feedback, or approvals do not qualify for refunds or billing adjustments.

      • If you fail to submit the onboarding questionnaire within 25 days of signup, we will create content based on our research, and no revisions will be permitted.

      • Unapproved content older than 30 days is deemed final, and revision requests are closed.

    • OffshoreUp-Caused Delays

      • Delays due to our errors will not result in refunds, but we may extend your billing cycle to compensate for lost time.

    • Automatic Content Creation

      • If we do not receive feedback before your next billing cycle, we will proceed with creating new content to fulfill your subscription.

9. Agencies & Resellers

  • Agencies & Resellers assume full responsibility for client payments. No refunds if your client defaults.

10. Payment Disputes & Abusive Conduct

  • Credit Card Disputes

    • Do not dispute charges for reasons already addressed in our Terms or Refund Policy.

    • Disputes will result in:

      • Immediate, irreversible deletion of all deliverables and published content.

      • Suspension of your account, credits, and communication.

    • If a dispute is resolved in your favor, you will receive an invoice for the disputed amount + a $50 fee. Non-payment triggers collections and credit bureau reporting.

  • Blackmail, Threats & Extortion

    • We prohibit:

      • Threats of payment disputes or negative reviews to extort refunds.

      • False or retaliatory reviews tied to refund requests.

    • Consequences include:

      • Legal action for damages (civil) or criminal charges (where applicable).

      • Reporting to review platforms (e.g., Google, Trustpilot) for policy violations.
